Terms of sale

These general terms and conditions of sale are concluded between, on the one hand,

and, secondly, any individual of legal age wishing to make a purchase via the Nénés website (www.nenes-paris.com), the exclusive property of Nénés.

1 - Object


The present conditions govern the sale of all products presented on the www.nenes-paris.com site by the company Nénés. They aim to define the reciprocal obligations of the parties as well as the various stages of the ordering process.

These conditions may be subject to change. It is therefore understood that the applicable conditions are those in force on the site at the time the contract is placed.

The parties agree that their relationship will be exclusively governed by this contract, to the exclusion of any other condition. The items offered for sale may not be transferred in any way whatsoever.

Any order duly validated on the www.nenes-paris.com website implies total and unreserved acceptance of these general terms and conditions of sale.

2 - Items and products


The items visible on the www.nenes-paris.com site can only be delivered while stocks last. If the product is not available, Nénés undertakes to inform the buyer as soon as possible by e-mail or telephone. The buyer will then have the option of choosing another article or cancelling the order and being reimbursed.
Any complaint from the customer concerning the order or delivery of an unavailable item will be considered unfounded.
Nénés endeavours to describe the products offered for sale as accurately as possible. However, Nénés cannot be held responsible for any errors in this presentation. The illustrations and photos of the products supporting the text are not contractual. Under no circumstances may Nénés be held liable on the basis of said illustrations/photos.

3 - Prices

The prices shown on the www.nenes-paris.com website are in euros, including VAT. VAT is applied at the rate in force in mainland France at the time the order is placed. Any change in the rate will be applied immediately to the current order.

Product prices do not include carriage costs, which are extra. The buyer will be informed of the latter on the summary screen before final validation of the order.

The prices of Products are indicated in Swiss Francs (CHF) excluding taxes for orders placed in Switzerland, and do not include delivery charges, customs duties, import duties, state taxes or other local taxes.

The prices of the Products are indicated in US Dollars (USD) excluding taxes for orders placed in the United States, and do not include delivery charges, customs duties, import duties, state taxes or other local taxes.

The prices of the Products are indicated in pounds sterling (£ / GBP) for orders placed in the United Kingdom, including VAT and customs duties. The prices indicated include VAT and customs duties applicable on the date of the order. Any change in the rate will be applied immediately to the price of the items.
The price does not include delivery charges, which are extra. The buyer will be informed of these costs on the summary screen before the order is definitively confirmed.


For all orders placed from outside the European Union or French Overseas Departments and Territories, the prices indicated are exclusive of tax and do not include delivery charges (expect for the UK), customs duties, import duties, state taxes or other local taxes.

These duties are not the responsibility of Nénés. They are the sole responsibility of the buyer in terms of declarations and payments to the competent authorities of the country concerned.

The products remain the property of Nénés until full payment has been received.

4 - Order process

Customers wishing to place an order must follow the following procedure:

  • Product selection: the customer selects the product they wish to order.
  • Checking the contents of the selection: the customer checks the contents of their basket, while retaining the option of deleting the products they have selected.
  • Identification: the customer must fill in the identification form provided and provide the information requested (compulsory information: surname, first name, address, e-mail address, telephone number for delivery).
  • Checking the order: the customer checks the contents of their order, the total price and the delivery and billing addresses, while retaining the option of deleting a product or changing the billing and delivery address. They choose their method of payment and tacitly accept these general terms and conditions of sale by validating their order.
  • Acknowledgement of receipt of the order: the customer will receive an e-mail summarising the contents of their order, namely:
    • The order number
    • The list of products ordered;
    • Delivery details.

It is advisable to keep and print this document, which is the official proof of the order. The order is then recorded and processed by Nénés, which checks the availability of the product(s) ordered. Any order placed implies acceptance of the prices and descriptions of the products available for sale. Nénés undertakes to honour orders received on its Internet site only within the limits of available stocks. In the event of unavailability of the products ordered, Nénés will contact the customer by e-mail as soon as possible, in order to inform the customer of the cancellation or reimbursement of the order.

  • Order tracking: Customers will receive an e-mail with the tracking number for their parcel. It is also possible to track orders from the customer area.

5 - Delivery

5-1. GENERAL

The items offered for sale on www.nenes-paris.com can be delivered within Europe to the delivery address indicated by the customer on the order form.


5-2. TERMS OF DELIVERY

For all products, the order is prepared for dispatch from the Acolyt Bordeaux warehouse within an average of 48 working hours (subject to stock availability) from e-mail confirmation of the order.

Orders are then delivered by recorded delivery (La Poste), Colissimo, Chronopost, Mondial Relay or UPS. From the moment the carrier takes charge of the order, the customer is delivered at home or to a relay point within the times specified below.


5-3. DELIVERY TIMES AND PRICES

The delivery times announced on the site apply from the time the customer receives the order confirmation e-mail sent by Nénés. It takes 2 to 5 working days to receive the order after receiving the tracking number.

Deliveries within France and the European Union are invoiced with French VAT.

For deliveries outside mainland France, shipping costs are invoiced exclusive of VAT. Customs or import duties are not included in the delivery costs shown and are payable by the customer, except for the UK.

The delivery times announced on the site are purely indicative and depend on the destination and availability of the product ordered. If the delivery time is exceeded, the order may not be cancelled, the price paid by the purchaser may not be reduced and no payment may be made by way of damages. However, and in accordance with the provisions of article L.121-20-3 of the French Consumer Code, in the absence of delivery at the end of a period of thirty days from the day following the day on which the customer placed his/her order, the customer will have the option of cancelling his/her order free of charge. The sums paid will then be refunded.

In cases where it is able to do so, Nénés reserves the right to offer a product of equivalent quality and price to the initial product.

Nénés shall not be held responsible for additional delays caused by the non-issuance of a bank authorisation or an incomplete order form.

In the event of partial delivery, transport costs will only be invoiced for the first delivery.

6 - Payment

Customers may pay by credit card directly on the site, using Visa, Mastercard, Amex or their Paypal account.
Payment methods such as bank transfer and cash on delivery are not accepted.
The invoice amount will be debited from the customer's account on the date of payment.
To ensure payment security, the www.nenes-paris.com website uses the Payplug secure payment service. This service incorporates the SSL security standard. Confidential data (the 16-digit bank card number, the expiry date and the visual cryptogram) are transmitted encrypted directly to the Payplug server without passing through the physical media of the www.nenes-paris.com server.
When the order is validated, the payment request is routed in real time to the Payplug telepayment manager. The latter sends an authorisation request to the credit card network. The remote payment manager issues an electronic certificate.
For any payment by bank card on the www.nenes-paris.com website, the electronic certificate issued by the remote payment manager will constitute proof of the amount and date of the transaction, in accordance with the provisions of articles 1316 et seq. of the French Civil Code. In this respect, the dates and times of the server will be taken as proof between the parties.

www.nenes-paris.com reserves the right to refuse an order if there is a previous dispute in progress or an abnormally high level of orders.

You acknowledge that the "double click" associated with the tick box on the acknowledgement of the general terms and conditions constitutes consent to contract and irrevocable and unreserved acceptance of the general terms and conditions of the product. In the absence of proof to the contrary, the data recorded by Oney Bank constitutes proof of all transactions between you and Oney Bank.
If you ask to benefit from a financing solution offered by Oney Bank, the information relating to your order will be transmitted to Oney Bank, which will use it to study your request for the purposes of granting, managing and collecting credit. Oney Bank reserves the right to accept or refuse your request for 3x 4x Oney financing. You have 14 days in which to withdraw from your loan.

How does it work? Payment in 3 or 4 instalments by credit card allows you to pay for your order on our website as follows

  • A compulsory deposit, debited on the day of confirmation of dispatch of your order, corresponding to one third or one quarter of the order, to which are added charges corresponding to 1.45% of the total amount of the order for a 3-time payment and 2.2% for a 4-time payment (up to a maximum of €15 for a 3-time payment and €30 for a 4-time payment);
  • Two or three monthly instalments, each corresponding to a third or a quarter of the order, debited 30 and 60 days after the order date for 3-time payment and 30, 60 and 90 days after the order date for 4-time payment.

7 - Right of withdrawal

The buyer has a period of 20 days in which to exercise his right of withdrawal from the date of receipt of his order, as evidenced by the date of posting. Within 20 days of receipt of the goods ordered, the buyer may therefore request an exchange or refund of the item(s) purchased.
After the 20-day period, Nénés is free to refuse the exchange, credit note or refund.

Purchasers of gift cards have 14 days to exercise their right of withdrawal. Within the 14 days following the purchase of the gift card, the purchaser may request an exchange or refund, provided that the card has not been used. In this case, Nénés will deactivate the gift card and proceed with the refund. After this period, Nénés may freely refuse to refund or exchange the gift card.

The refund procedure is as follows:
The buyer must inform Nénés of their wish to withdraw within 20 days of receiving their order. The retraction form can be found here.
The buyer follows the exchange or reimbursement procedure which will be communicated to him/her by e-mail after filling out the form. If the buyer returns the items by his/her own means, it is strongly advised to keep the tracking number until Nénés has confirmed receipt. In the event of loss of the parcel by the carrier, this tracking number will serve as proof.

7.1 EXCHANGES

Exchanging an item purchased on the website

Exchanges can be made via the Nénés website or in shop at our Paris Showroom at 17 rue Feutrier 18ème or at our Marseille Showroom at 2 place Francis Chirat 2nd.
Exchanges will be made for the same item or another item in  if the price is the same and subject to stock availability, or for a gift card for the same price. Unless otherwise specified, the exchange will be processed within a maximum of 20 days from the date on which Nénés is informed of the customer's decision, provided that the product is returned in its original packaging, in perfect condition, unworn, unwashed, labelled and correctly folded.

Returns are free of charge in mainland France, Belgium, Germany, the Netherlands, Italy, Luxembourg, Austria, Spain, Ireland, Portugal, Poland, the Czech Republic, Slovakia, Finland and Greece. In other countries, the cost of returning the goods shall be borne by the buyer. Nénés will bear the costs of re-delivery in Europe and insofar as the total amount of shipping costs borne by Nénés does not exceed the total amount of the customer's order.

Re-delivery costs are covered within the limit of one exchange for one order number. If after an exchange the person wishes a refund, the return costs will be deducted from the total amount to be refunded.

Please note that for orders returned from outside the EU, please declare the parcel as "returned goods" to avoid customs charges. Otherwise, Nénés will be obliged to refuse the return parcel on receipt.

If the buyer returns the items by his/her own means, it is strongly advised to keep the tracking number until Nénés has confirmed receipt. In the event of loss of the parcel by the carrier, this tracking number will serve as proof.

Exchanging an item purchased in shop

Exchanges can only be made in our Paris Showroom at 17 rue Feutrier 18ème or in our Marseille Showroom at 2 place Francis Chirat 2nd.
Exchanges may be made for another item or the same item in a different size if the price is the same and subject to stock availability, or for a gift card for the same price. Unless otherwise indicated, exchanges are possible within a maximum of 20 days from the date of purchase, provided that the product is returned in its original packaging, in perfect condition, unworn, unwashed, labelled and correctly folded.

7.2 REFUNDS

Refund of an item purchased on the website

An item may be reimbursed via the Nénés website or in shop at our Paris Showroom at 17 rue Feutrier 18ème or at the Marseille Showroom at 2 place Francis Chirat 2ème.
If the customer chooses to be reimbursed, Nénés Paris will reimburse the customer for the price of the product(s), unless otherwise indicated, within a maximum of 20 days from the date of receipt of the items, as evidenced by La Poste tracking, provided that the product is returned in its original packaging, in perfect condition, unwashed, unworn, labelled and correctly folded. If the product is returned in a condition that does not allow it to be sold again, it will not be reimbursed. If the product is returned dirty and cannot be put back on sale immediately, a cleaning fee of €5 (incl. VAT) per item will be deducted from the total amount to be refunded.

To obtain a refund, the customer must first fill in the returns form available here. The procedure will then be specified by e-mail. Reimbursement will be deferred until the products have been recovered, within a maximum of 7 days from receipt of the returned products by Nénés. The refund will be made using the same means of payment as that used for the initial transaction. The cost of returning the product(s) to be reimbursed shall be borne by the client. If Nénés Paris has sent a return voucher to the customer, this amount (including VAT) will be deducted from the total amount refunded to the customer. For information, Nénés deducts 4.90€TTC for a return from France and 8.90€TTC for a return from other EU countries.

If the buyer returns his items by his own means, he is strongly advised to keep the tracking number until Nénés has confirmed receipt. In the event of loss of the parcel by the carrier, this tracking number will serve as proof.

Please note that for orders returned from outside the EU, please declare the parcel as "returned goods" to avoid customs charges. Otherwise, Nénés will be obliged to refuse the return parcel on receipt.

If the buyer has paid for the entire order with a Nénés gift card, the refund will only be made on the gift card used. If the buyer has paid for his/her order on the Nénés site with a gift card and another means of payment, Nénés will reimburse the amount of the items returned on the gift card as a priority. In these two cases, the original purchaser of the gift card used will not be entitled to a refund.

On some items it is mentioned that the refund will not be accepted. In accordance with article L221-28 of the French Consumer Code, certain products such as lingerie or swimwear are exempt from the right of withdrawal for reasons of hygiene. Most of the time, Nénés accepts refunds for products sold on its website, but in certain cases Nénés reserves the right to apply article L221-28 of the French Consumer Code. In such cases, Nénés will exchange the product for another one on the website or offer a credit note valid on the website.

If the buyer has benefited from a product offered when ordering on the Nénés site and wishes to return this order for reimbursement, the offered product must be returned at the same time. If the product offered is not returned by the buyer, Nénés will deduct the value of this product from the refund of the order.

Refund of an item purchased in a boutique

Refunds can only be made in our Paris Showroom at 17 rue Feutrier 18ème or in our Marseille Showroom at 2 place Francis Chirat 2ème.

Nénés will reimburse the customer for the price of the product(s), unless otherwise specified, within a maximum of 20 days from the date of purchase of the items, provided that the product is returned in its original packaging, in perfect condition, unwashed, unworn, labelled and correctly folded. If the product is returned in a condition that does not allow it to be sold again, it will not be reimbursed.

The refund will be made using the same means of payment as that used for the initial transaction.

If the customer wishes to send the item by post, the cost of returning the product(s) to be refunded shall be borne by the customer. If Nénés has sent a return voucher to the customer, this amount will be deducted from the total amount refunded to the customer. For information, Nénés deducts 4.90€TTC for a return from France and 8.90€TTC for a return from other EU countries.

8 - Legal warranties and after-sales service

Products sold are covered by the legal guarantee of conformity provided by articles 211-4 et seq. of the French Consumer Code, and by the guarantee against hidden defects (articles 1641 et seq. of the French Civil Code). These warranties cover both hidden and visible defects from the date of delivery. The only obligation incumbent on Nénés Paris under this warranty is, at its option, the free replacement or repair of products recognized as defective, without any other service or compensation.
This warranty does not cover damage resulting from misuse of the product, normal wear and tear due to its use, or failure to follow washing and maintenance instructions. In order to benefit from the product warranty, it is imperative to keep the product purchase invoice. To request a return for a defective product, the buyer must make a claim by clicking here.

9 - Privacy policy

All nominative information collected from the customer is necessary to process the order, its routing and the establishment of the invoice.

This information may be passed on by Nénés to its contractual partners for the purpose of fulfilling the order, in particular to ensure the transport of the products ordered.

Nénés undertakes to protect this data concerning the customer. In accordance with the law "informatique et libertés" of 6/01/1978, modified by the law of 6 August 2004.
In accordance with article 34 of this same law, the customer has the right to access, modify, rectify and delete data concerning him or her. In this case, customers can modify their personal information directly in the "My account" section of the www.nenes-paris.com website, or send a request by e-mail to club@nenes-paris.com.


10 - Liability

Nénés may not be held liable for any events, inconveniences or damage inherent in the use of the Internet network, in particular in the event of service interruption, external intrusion or the presence of computer viruses.

Furthermore, Nénés shall not be held liable for non-performance of the contract in the event of unforeseen circumstances, force majeure, disruption or total or partial strike, notably of postal services and means of transport and/or communications, flood or fire. Nénés shall not be held liable for any indirect damage, operating loss, loss of profit, damage or expenses that may arise as a result of the present contract.

11 - Attribution of jurisdiction


These general terms and conditions of sale are governed by French law. Any dispute that cannot be settled amicably will be submitted to the exclusive jurisdiction of the competent courts of Paris or to the jurisdiction of the actual place of delivery of the customer's order, notwithstanding multiple defendants and/or third-party claims, even for emergency proceedings or protective proceedings in summary proceedings or by petition.

13 - Intellectual property rights


Trademarks, domain names, products, software, images, videos, texts or more generally any information subject to intellectual property rights are and remain the exclusive property of Nénés.
No transfer of intellectual property rights is made through these GCS. Any total or partial reproduction, modification or use of these goods is strictly forbidden.


14 - Legal notice

15 - Last Chance and Rescapés products


Products in the LAST CHANCE category cannot be refunded. However, Nénés offers a credit note or an exchange within 20 days of receipt of the product, as evidenced by the tracking number of the post office or carrier. All requests for exchange or credit must be made via this link. Exchanges are subject to stock availability. Credit notes are not limited in time.

LES RESCAPÉS products are unique pieces. They are most often prototypes or products used during shoots. Nénés offers them at very reduced prices. Consequently, these products cannot be returned or exchanged.

16 - The Second Hand and Repair service

16.1 SECOND HAND

As soon as you no longer use a Nénés brand product, you can ask Nénés to take back this product in exchange for a voucher valid on the website and in physical shops.

Nénés only accepts Nénés brand products in very good condition, i.e. without stains, holes, tears or any other trace of abnormal wear or new with or without a label. The brand label must be present on the product. The product must be sent clean. Nénés refuses products that are more than 3 years old.

You will receive the voucher only after receipt and inspection of the product by the Nénés team. If the product received does not meet the condition described by the Customer, Nénés reserves the right to reassess the amount of the voucher or to refuse the product. In the latter case, Nénés will donate these products to an association.

Nénés is responsible for the cost of shipping the product. Nénés reserves the right to refuse to receive the product if the shipping costs are too high.

This solution is only available in metropolitan France.

The amount of the voucher sent by Nénés on the occasion of this transaction cannot be reimbursed on the bank card or other means of payment, following a potential order return. The return of the order will automatically result in a new purchase voucher.

Nénés accepts returns of "Second Life" products within 14 days of receipt of the parcel. The cost of returning these orders will be borne by the customer, regardless of the reason for the return.

16.2 REPAIR SERVICE 

Nénés offers a free repair service for products purchased on its website within a period of two years from the date of receipt of the product, provided that the product has been used in accordance with its intended use and that it has been maintained in accordance with the maintenance instructions. Nénés offers a fee-based repair service for purchases for which the 2-year period has expired.

The buyer may make a written request by e-mail to the following address: club@nenes-paris.com, with photos of the product and its order number. After Nénés and Abracadabra Upcycling have assessed the repairability of the product, Nénés will inform the buyer of its decision. If Nénés agrees to repair the product, the buyer must return the item to the following address:

Nénés cannot be held responsible for the possible loss of the parcel in the event of an incident. Nénés will be responsible for returning the product to the buyer once the repair has been completed. Nénés cannot guarantee repair times or delivery of the repaired product.
